PART I — ENGLISH

 

LULA Activewear (“LULA”, “we”, “us”) operates the online store at lula-activewear.com. We are the data controller of the personal information processed through this website.

We do not sell to residents of Turkey.

 

We collect personal information only to the extent necessary to operate our store and serve you. Depending on how you interact with us, this may include:

 

–     Identity & contact data: name, delivery and billing address, email address, phone number

–     Order & transaction data: items purchased, order history, payment confirmation (we do not store full card numbers — payment processing is handled by Shopify Payments / third-party processors)

–     Account data: username, password, preferences (if you create an account)

–     Communications: messages you send us for support or enquiries

–     Technical data: IP address, browser type, device identifiers, browsing activity on our site

 

No cookies or tracking pixels. We do not use analytics cookies, advertising pixels, or behavioural tracking tools. Basic session cookies required for the store to function are strictly necessary and do not require consent.

 

We process your personal information only where we have a lawful basis to do so under Article 6 GDPR / UK GDPR:

Where we rely on legitimate interests (Art. 6(1)(f)), those interests are: operating and securing our store, preventing fraud, and maintaining effective customer support. These interests do not override your fundamental rights.

 

–     Order and transaction records: 7 years from the transaction date (tax and commercial law obligations)

–     Account data: for the duration of your account, plus 2 years after closure

–     Customer support communications: 2 years from resolution

–     Marketing consent records: until you withdraw consent, plus 1 year

–     Technical / log data: up to 12 months

 

After the applicable retention period, data is securely deleted or anonymised.

 

We share personal information only where necessary and only with the following categories of recipients acting as processors or independent controllers, as applicable:

 

–     Shopify Inc. (Canada / USA) — store platform and infrastructure. Shopify is certified under EU–US Data Privacy Framework and processes data under its own DPA with us.

–     Payment processors (PayPal / İyziCo [Türkiye based entity]) — solely for transaction processing; they do not receive data for their own purposes.

–     Dropshipping entity (CJDropShipping [China based entity]) to fulfill your orders.

–     Shipping carriers — name and delivery address only, to fulfil your order.

–     Legal and regulatory authorities — where required by law, court order or regulatory request.

 

We do not sell your personal information. We do not share your data with advertising networks or use it for behavioural targeting.

 

Our controller entity is based in Turkey. Data processed through Shopify may also be transferred to the United States and other countries outside the EEA/UK.

 

All such transfers are safeguarded by one or more of the following mechanisms:

–     Standard Contractual Clauses (SCCs) — EU Commission Decision 2021/914 for EEA-origin transfers

–     UK International Data Transfer Agreement (IDTA) or UK Addendum to EU SCCs for UK-origin transfers

–     Adequacy decisions where the destination country has been deemed adequate by the European Commission or UK Secretary of State

 

Specifically regarding the controller being established in Turkey: Turkey is not currently the subject of an EU adequacy decision. Transfers of EEA personal data to our Turkish entity are governed by the SCCs referenced above. No personal data of Turkish residents is collected or transferred.

 

If you are located in the EEA or the UK, you have the following rights under GDPR / UK GDPR:

 

–     Access (Art. 15): obtain confirmation of whether we process data about you and receive a copy

–     Rectification (Art. 16): request correction of inaccurate or incomplete data

–     Erasure (Art. 17): request deletion where data is no longer necessary, consent is withdrawn, or processing is unlawful

–     Restriction (Art. 18): request that we restrict processing in certain circumstances

–     Portability (Art. 20): receive your data in a structured, machine-readable format

–     Objection (Art. 21): object to processing based on legitimate interests or for direct marketing at any time

–     Withdrawal of consent: where processing is based on consent, you may withdraw it at any time without affecting prior lawful processing

 

To exercise any right, contact us at mylula.activewear@gmail.com. We will respond within one month as required by Art. 12 GDPR. We may need to verify your identity before processing your request.

 

You have the right to lodge a complaint with a data protection supervisory authority. Since our EU Representative is based in Turkey (a third country) and we have not designated a primary establishment in the EEA, you may lodge a complaint with the supervisory authority in your country of habitual residence, place of work, or place of the alleged infringement.

We encourage you to contact us first at contact@lula-activewear.com so we can resolve any concerns directly.

 

We implement appropriate technical and organisational measures to protect your personal information against unauthorised access, loss or destruction. Our store is hosted on Shopify's secure infrastructure. No method of electronic transmission is 100% secure; we encourage you not to share sensitive information over unsecured channels.

 

We may update this Privacy Policy from time to time. Material changes will be notified by posting the revised policy on our website with an updated date. Your continued use of the store after such changes constitutes acceptance of the revised policy.

 

 

BÖLÜM II — TÜRKÇE

 

Bu Bölüm Hakkında: Bu bölüm, 6698 sayılı Kişisel Verilerin Korunması Kanunu ('KVKK') kapsamındaki aydınlatma yükümlülüğünü yerine getirmek amacıyla hazırlanmıştır. LULA Activewear, Türkiye'de kurulu bir veri sorumlusudur. Bununla birlikte, yalnızca Avrupa Ekonomik Alanı ('AEA') ve Birleşik Krallık'taki müşterilere satış yapmakta; Türkiye'deki kişilerden veri toplamamaktadır.

 

6698 sayılı KVKK'nın 10. maddesi uyarınca aşağıdaki bilgiler tarafınıza sunulmaktadır:

VERBİS Kaydı Hakkında Not

LULA Activewear yalnızca AEA ve Birleşik Krallık'taki kişilere ait verileri işlemekte olup Türkiye'deki gerçek kişilere ilişkin herhangi bir kişisel veri toplamamaktadır. Bu itibarla, Türkiye'deki veri sahipleri bakımından Veri Sorumluları Sicil Bilgi Sistemi'ne (VERBİS) kayıt yükümlülüğü doğmamaktadır.

 

Web sitemizi kullanan AEA ve Birleşik Krallık'taki kişilere ait aşağıdaki kategorilerde kişisel veriler, belirtilen amaçlarla işlenmektedir:

 

–     Kimlik ve iletişim bilgileri (ad, adres, e-posta, telefon): sipariş yerine getirme ve müşteri desteği

–     Sipariş ve işlem verileri: sözleşmenin ifası ve yasal yükümlülüklere uyum

–     Hesap bilgileri: hesabın oluşturulması ve yönetimi

–     İletişim kayıtları: müşteri taleplerine yanıt verilmesi

–     Teknik veriler (IP adresi, tarayıcı bilgisi): sitenin güvenli işletilmesi ve sahtekârlığın önlenmesi

 

Kişisel verileriniz KVKK'nın 5. maddesi kapsamında aşağıdaki hukuki dayanaklar çerçevesinde işlenmektedir:

 

–     Madde 5(2)(c): Bir sözleşmenin kurulması veya ifasıyla doğrudan ilgili olması — sipariş ve teslimat işlemleri

–     Madde 5(2)(ç): Veri sorumlusunun hukuki yükümlülüğünü yerine getirebilmesi için zorunlu olması — vergi ve ticaret hukuku kapsamındaki kayıt yükümlülükleri

–     Madde 5(2)(f): İlgili kişinin temel hak ve özgürlüklerine zarar vermemek kaydıyla veri sorumlusunun meşru menfaatleri için zorunlu olması — güvenlik, sahtekârlıkla mücadele, müşteri desteği

–     Madde 5(1): Açık rıza — yalnızca pazarlama iletişimleri için, rızanın verilmesi halinde

 

Kişisel verileriniz aşağıdaki alıcı kategorilerine aktarılmaktadır:

 

–     Shopify Inc. (Kanada/ABD) — mağaza altyapısı ve sipariş yönetimi

–     Ödeme kuruluşları (PayPal / İyziCo) — yalnızca ödeme işlemleri amacıyla

–     CJDropShipping - DropShipping yöntemiyle siparişlerin yönetilmesi ve teslimatının sağlanması

–     Kargo ve lojistik şirketleri — teslimat adresine ürünün iletilmesi amacıyla, yalnızca ad ve adres bilgisi

–     Yetkili kamu kurum ve kuruluşları — hukuki zorunluluk halinde

 

Türkiye'ye herhangi bir kişisel veri aktarımı yapılmamaktadır; Türkiye'deki kişilerden veri toplanmamaktadır. Bu nedenle KVKK'nın 9. maddesi kapsamında yurt dışına aktarım değerlendirmesi yalnızca AEA/Birleşik Krallık müşterilerine ilişkin veriler bakımından geçerlidir; bu aktarımlar İngilizce bölümde açıklanan SCCs ve IDTA mekanizmaları aracılığıyla güvence altına alınmaktadır.

 

–     Sipariş ve işlem kayıtları: işlem tarihinden itibaren 7 yıl (Türk Ticaret Kanunu ve vergi mevzuatı gereği)

–     Hesap bilgileri: hesabın aktif olduğu süre boyunca ve hesap kapatılmasından itibaren 2 yıl

–     Müşteri destek yazışmaları: çözümden itibaren 2 yıl

–     Pazarlama rızası kayıtları: rıza geri alınana kadar ve geri alınmasından sonra 1 yıl

–     Teknik/log verileri: en fazla 12 ay

 

KVKK'nın 11. maddesi uyarınca kişisel verilerinizle ilgili olarak aşağıdaki haklara sahipsiniz:

 

–     Kişisel verilerinizin işlenip işlenmediğini öğrenme

–     Kişisel verileriniz işlenmişse buna ilişkin bilgi talep etme

–     Kişisel verilerinizin işlenme amacını ve bunların amacına uygun kullanılıp kullanılmadığını öğrenme

–     Yurt içinde veya yurt dışında kişisel verilerinizin aktarıldığı üçüncü kişileri bilme

–     Kişisel verilerinizin eksik veya yanlış işlenmiş olması hâlinde bunların düzeltilmesini isteme

–     KVKK'nın 7. maddesinde öngörülen şartlar çerçevesinde kişisel verilerinizin silinmesini veya yok edilmesini isteme

–     Eksik/yanlış işleme ile silme/yok etme taleplerinin, verilerin aktarıldığı üçüncü kişilere bildirilmesini isteme

–     İşlenen verilerin münhasıran otomatik sistemler vasıtasıyla analiz edilmesi suretiyle aleyhinize bir sonucun ortaya çıkmasına itiraz etme

–     Kişisel verilerinizin kanuna aykırı olarak işlenmesi sebebiyle zarara uğramanız hâlinde zararın giderilmesini talep etme

KVKK kapsamındaki şikâyetleriniz için ayrıca Kişisel Verileri Koruma Kurumu'na (kvkk.gov.tr) başvurma hakkınız saklıdır.

 

Bu Politika zaman zaman güncellenebilir. Önemli değişiklikler, revize edilmiş politikanın güncelleme tarihi ile birlikte web sitemizde yayımlanması suretiyle duyurulacaktır.
